Terms of Service

1. Acceptance of Terms

By accessing or using GameSpace ("Service"), operated by GameSpace LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

GameSpace is an online platform that connects coaches, teams, and individuals with sports facility owners for booking courts, fields, and other athletic venues. The Service facilitates:

• Searching and discovering sports facilities
• Booking facilities for specific time slots
• Processing payments between users and facility owners
• Communication between parties regarding bookings
• Publishing information about sports venues, including venues that have not joined GameSpace (see section 2A)

2A. Venue Listings and Unclaimed Venues

2A.1 Unclaimed Listings

Some venues shown on GameSpace have not joined GameSpace. We call these unclaimed listings. We build them from public sources: OpenStreetMap, Wikidata, the venue's or its operator's own public website, photographs licensed for reuse (for example under a Creative Commons licence), and information our team has entered by hand. Each listing credits where its information came from. GameSpace does not own or operate these venues and is not affiliated with them unless the listing says it has been claimed. You cannot book an unclaimed venue through GameSpace. Any arrangement you make with one is between you and that venue.

2A.2 Reported Information

Prices, hours, rentals, practice areas, availability, and photographs on an unclaimed listing are shown as reported by their source. They are not verified by GameSpace. GameSpace does not set or guarantee them, and they may be out of date. Confirm them with the venue before you rely on them.

2A.3 Map and Location Data

Place names: US Census and GeoNames (CC BY 4.0). Location data from OpenStreetMap is © OpenStreetMap contributors and is available under the Open Database License (ODbL) 1.0. We credit it on each page that uses it. Your use of OpenStreetMap-derived data is governed by the ODbL, not by these Terms. To request a copy of the OpenStreetMap-derived data we publish, contact us at the address in section 13.

2A.4 Corrections and Removal

If you run a venue, you can claim its listing (section 6A) to control what it says, or ask us to correct or remove it. To ask, email support@trygamespace.com with the subject "Listing correction" or "Listing removal", the listing's web address, what should change, and your connection to the venue.

Before we remove a listing, we check that the request comes from someone authorised to act for the venue: for example, by writing back to an email address published on the venue's own website, by asking you to publish a DNS record on the website the listing shows, or by asking you to claim the listing. We may decline a removal request we cannot verify.

A removed listing stays removed. We record the removal against the venue's source identifiers, and the listing is not published again when we refresh listing data from our sources. Removing a listing from GameSpace does not remove the venue from OpenStreetMap or any other public source. If you later want the listing back, contact us.

If you believe a photograph or other material on GameSpace infringes your copyright, see section 6B.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Booking and Payments

4.1 Bookings

When you make a booking through GameSpace, you enter into an agreement with the facility owner. We act as an intermediary to facilitate this transaction but are not a party to the booking agreement between you and the facility.

4.2 Payments

All payments are processed through our third-party payment processor (Stripe). By making a payment, you agree to their terms of service. We do not store your full payment card information on our servers.

4.3 Cancellations and Refunds

Cancellation policies are set by individual facility owners. Please review the cancellation policy for each facility before booking. Refunds, when applicable, will be processed according to the facility's stated policy.

5. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Submit false or misleading information
• Claim, or ask us to change or remove, a listing for a venue you are not authorised to act for
• Copy, scrape, or bulk-extract listings or other content from the Service, except OpenStreetMap-derived data used under the ODbL
• Use contact information shown on a listing to send unsolicited bulk messages
• Interfere with the operation of the Service
• Attempt to gain unauthorized access to any systems
• Use the Service for any fraudulent purpose

6. Facility Owner Responsibilities

Facility owners who list their venues on GameSpace agree to:

• Provide accurate descriptions of their facilities
• Maintain facilities in safe and usable condition
• Honor confirmed bookings
• Respond to user inquiries in a timely manner
• Comply with all applicable local laws and regulations

6A. Claiming a Listing

Claiming a listing is free. When you claim one, you confirm that you are authorised to act for that venue and that the information you give us is true. We verify claims before we give anyone control of a listing, for example by reviewing the email address you give us or by asking you to publish a DNS record on the website the listing already shows. We may refuse a claim we cannot verify, and we may reverse an approved claim if we later learn it was not authorised. While a claim is under review, the listing stays as it was. When a claim is approved, you become responsible under section 6 for what the listing says.

Licence to your content. When you add or change listing content, including text, prices, hours, and photographs, you grant GameSpace a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt for display, and distribute it to operate and promote the Service. You confirm you have the rights to grant this licence. The licence ends when you remove the content, except for copies kept in backups or legal records for a limited time.

6B. Copyright Complaints

If you believe a photograph or other material on GameSpace infringes your copyright, email support@trygamespace.com with the subject "Copyright complaint", or write to us at the postal address in section 13. Please include:

• Your name and contact details (postal address, phone number, and email address)
• A description of the copyrighted work you believe is infringed
• The web address of each page on GameSpace where the material appears
• A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf
• Your physical or electronic signature

We review every complaint we receive and remove or disable access to material that we find infringes, or that a complete notice identifies.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE PAST TWELVE MONTHS.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

INFORMATION IN VENUE LISTINGS, INCLUDING REPORTED PRICES, HOURS, AVAILABILITY, RENTALS, AMENITIES, AND PHOTOGRAPHS, IS PROVIDED AS FOUND IN ITS SOURCE, WITHOUT ANY WARRANTY THAT IT IS ACCURATE, CURRENT, OR COMPLETE. WE ARE NOT RESPONSIBLE FOR THE ACTS, FACILITIES, OR POLICIES OF ANY VENUE, INCLUDING ONE YOU FIND THROUGH AN UNCLAIMED LISTING.

9. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Knox County, Tennessee.
